Deep 3D Print

Deep 3D Print – Terms and Conditions

1. About these Terms

These Terms govern your use of the Deep 3D Print app for iOS and, where available, Android, and related services (the “App”). By creating an account or using the App, you accept these Terms and our Privacy Policy.

The App is provided by OVER THE TAP S.R.L. (“we”, “us”), Viale Campania 33, 20133 Milano, Italy · VAT and tax code IT 14769570962 · REA MI-2806579 · share capital € 10,980.00 fully paid · PEC overthetap@pec.it · contact hello@overthetap.it.

If you are a consumer, nothing in these Terms limits the rights that the law of your country gives you and that cannot be excluded by contract.

2. Eligibility and your account

You must be at least 18 years old, or the age of majority where you live if higher, to use the App. By using it, you confirm that you are.

You can sign in with Apple, Google or email. You are responsible for keeping access to your account secure and for activity carried out through it. Tell us at hello@overthetap.it if you think your account has been compromised.

You may use the App for personal purposes and for your own business, for example to create models you print and sell. You may not resell access to the App, copy or reverse engineer it, or extract its content with automated tools, except as allowed by law.

3. The service and AI-generated results

The App lets you generate images and 3D models from text, photos and 3D files, edit models (for example repair, colour reduction, colour changes, textures), manage your printers and filaments, and ask a print assistant for advice.

Results come from third-party AI models. Generation uses models developed by third parties, which you can see and choose in the App. Results vary, may contain errors or artefacts, and may differ from what you expected. We do not guarantee that a result is accurate, original, suitable for a specific purpose or printable on your printer.

The assistant gives guidance only. Print advice and assistant answers, including those based on web search, may be wrong or out of date. Check them before applying them, especially for settings that may affect safety or your equipment.

We do not change your models on our own. The App alters a model only when you ask. Each edit creates a new version and the original stays available.

Content is AI-generated. Images and models produced by the App are created with AI. Do not present them as something they are not where this could mislead others, for example as real photographs of real people.

4. Credits

Most features are paid with credits, a virtual unit you get with a subscription or buy in credit packs.

  • Cost. Each action costs a number of credits that depends on the feature, the engine and the options you choose. The assistant charges according to actual use, with a maximum per answer. The cost shown in the App before you confirm is the one that applies. We may change credit costs for future actions; changes never apply to actions already confirmed.
  • No expiry. Credits do not expire. Credits included in a subscription stay in your balance after the subscription ends. Credits from the annual plan are added in full at the start of the plan.
  • No cash value. Credits are a licence to use the App’s features. They cannot be exchanged for money, transferred to another account or sold, except where the law requires otherwise.
  • Deleting your account. If you delete your account, your credit balance is lost. The App reminds you of this before deletion.

5. Subscriptions and purchases

Plans (weekly, monthly, annual), credit packs, their prices and the credits included are shown in the App before you buy. Prices include the taxes applicable in your country where the store requires it.

  • Who you pay. In-app purchases are made through the Apple App Store or Google Play, which process the payment under their own terms.
  • Auto-renewal. Subscriptions renew automatically at the end of each period at the then-current price, unless you cancel at least 24 hours before the period ends. Your store account is charged within 24 hours before renewal.
  • Cancelling. You can cancel at any time in your App Store or Google Play account settings. Cancellation stops the next renewal; the current period continues until its end. Deleting the App or your account does not cancel a subscription.
  • Free trials. If we offer a free trial, the App shows its length and the price charged when it ends. Cancel before the end of the trial to avoid being charged.
  • Price changes. We will tell you about a price increase for an active subscription in advance, as required by the store, and you can cancel before it applies.

6. Refunds and right of withdrawal

Credit refunds inside the App. Credits for an action are returned automatically to your balance when:

  • the generation or edit fails; or
  • the resulting 3D model is unusable (for example an empty or corrupted mesh).

Credits are not returned when:

  • the action completed but the result does not match your expectations (section 3);
  • the automatic analysis after generation fails: the model stays available, with some features limited;
  • you leave the screen while previews are being generated.

If you think credits were charged by mistake, write to hello@overthetap.it within 30 days.

Refunds of payments. Payments made through the App Store or Google Play are refunded only by Apple or Google, under their policies; we cannot issue them. If a purchase is refunded, we may remove the corresponding credits from your balance.

Right of withdrawal (EU and UK consumers). For in-app purchases, the seller is Apple or Google and the cancellation rights in their terms apply. If in the future we sell credits or subscriptions directly (for example on the web), you will have 14 days to withdraw; as they are digital content supplied immediately, at checkout we will ask for your express consent to immediate supply and your acknowledgement that you lose the right of withdrawal once supply has started.

7. Your content and generated models

Your inputs. You keep all rights in the prompts, photos and files you upload. You confirm that you have the rights needed to use them, and the consent of any person shown in your photos.

Generated results. As between you and us, you own the images and 3D models you generate and may use them for any lawful purpose, including commercial use such as selling prints. The App only offers AI engines whose licence allows commercial use of their outputs; each engine’s own licence still applies. We claim no ownership over your results. Depending on the law, AI-generated content may not be protected by copyright, and other users may obtain similar results.

Licence to us. You give us a non-exclusive, worldwide, royalty-free licence to store, process, convert and display your content and results only as needed to run the App for you, including sending them to the AI providers that carry out your requests. This licence ends when you delete the content or your account, except for copies we must keep by law. We do not use your content in our marketing without your permission.

The App is ours. We own the App, its software, design and brand. These Terms do not give you any right to use our trademarks.

8. Acceptable use

You must not use the App to create, upload or print:

  • weapons, parts or accessories of weapons (including firearm components, silencers, magazines), or other objects that are illegal to make or own where you live;
  • objects or content that infringe trademarks, copyright, designs or other rights, such as protected characters, logos or branded products, unless you have permission;
  • images of real people without their consent, or content that sexualises minors, is sexually explicit, violent, hateful or harassing;
  • content that reveals sensitive personal data of others;
  • content used to deceive, impersonate or defraud.

You must also not try to bypass content filters or credit charges, overload or attack the App, use it to build a competing service, or use results to train or improve AI models that compete with the engines that produced them. You must follow the usage policies of the AI providers that power the App, which may block requests that violate them. If you break these rules, we may remove the content and act under section 12.

9. 3D printing and safety

The App produces digital files. You decide whether and how to print them, with your own printer, materials and settings.

  • Check every model and every setting suggested by the App before printing. We are not responsible for failed prints, wasted material or damage to printers, unless caused by our wilful misconduct or gross negligence.
  • Printed objects are not tested or certified by us. Do not use them where failure could cause harm, such as load-bearing parts, safety equipment, vehicle or medical parts, or children’s toys, unless you have verified their suitability.
  • Common 3D printing materials and processes are not food-safe. Do not use printed objects in contact with food or drink unless the material and process are certified for it.
  • You are responsible for the objects you print and how you use, sell or give them away, including compliance with product safety rules.

10. Third-party services

The App relies on third-party services, such as sign-in with Apple and Google, the app stores, cloud infrastructure and AI model providers. Their availability may affect the App, and their own terms may apply to you.

When you open a model in a third-party slicer (such as Bambu Studio, OrcaSlicer, Snapmaker Orca or Anycubic Slicer Next) or share it, the App only passes a file or a download link. We do not control that software and are not responsible for it; its own terms and privacy policy apply.

The App needs an internet connection. Data charges from your mobile or internet provider are your responsibility.

11. Reporting illegal content

Content in the App is private to your account and is not published to other users. We store it on your behalf and may moderate it in line with section 8.

Single point of contact. Under the EU Digital Services Act, authorities and users can contact us at hello@overthetap.it, in English or Italian.

Notices. Anyone can report content they believe is illegal by writing to hello@overthetap.it. The notice should explain why the content is illegal, identify it as precisely as possible, and include your name and email (unless the report concerns child sexual abuse material). We confirm receipt, review the notice diligently and tell you our decision.

Our decisions. If we remove content or restrict or close an account, we tell the person concerned what we did, why, the rule or law it is based on, whether automated tools were involved, and how to contest it. You can ask us to review the decision by replying to that message, and you can always go to court. We report suspected criminal offences that threaten life or safety to the competent authorities.

12. Suspension, termination and discontinuation

By you. You can stop using the App and delete your account at any time in your Profile. Remember to cancel any active subscription in your store settings.

By us. If you breach these Terms, we will tell you and, where the breach can be fixed, give you 14 days to fix it before suspending or closing your account. We may act immediately, without notice, if the breach is serious: illegal content or activity, infringement of others’ rights, fraud, attempts to get credits without paying, or a risk to other users or to the App. In these cases unused credits are lost, except where the law requires otherwise.

If we discontinue the App. We may stop offering the App or one of its features. We will give you at least 60 days’ notice, so you can use your credits and download your models, and we will stop renewals. Where required by law, we will refund the credits you paid for and could not use.

13. Liability

We provide the App with reasonable care and skill, but we do not guarantee that it will always be available, uninterrupted or free of errors. We may carry out maintenance that temporarily limits access.

To the extent permitted by law:

  • we are not liable for indirect or unforeseeable losses, such as loss of profit, business or data you did not back up;
  • our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

These limits do not apply to liability for wilful misconduct or gross negligence, for death or personal injury, or to any liability that cannot be limited by law, including your statutory rights as a consumer for non-conforming digital content.

You are responsible for damage caused to us or to third parties by content you upload or by your breach of section 8, except where we caused it.

14. Changes to the App and to these Terms

We improve the App over time and may add, change or replace features and AI engines. If a change significantly reduces what you paid for, we will tell you in advance and you may cancel your subscription.

We may update these Terms for legal, technical or business reasons. For material changes we will notify you in the App at least 30 days before they apply. If you do not agree, you can stop using the App and delete your account before the changes take effect. Previous versions are available on request.

15. Additional terms for the Apple App Store

If you downloaded the App from the Apple App Store:

  • these Terms are between you and us, not Apple. We, not Apple, are solely responsible for the App and its content;
  • your licence to use the App is limited to Apple-branded devices you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms;
  • Apple has no obligation to provide maintenance or support for the App;
  • if the App does not conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation regarding the App;
  • we, not Apple, are responsible for handling any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, consumer protection claims and intellectual property infringement claims;
  • you confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties;
  • you must comply with applicable third-party terms when using the App;
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Governing law, disputes and contact

These Terms are governed by Italian law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live.

If you are a consumer resident in the EU, you can bring a claim in the courts of the place where you live. For users who are not consumers, the courts of Milan, Italy have exclusive jurisdiction.

If you have a problem, write to us first at hello@overthetap.it: most issues can be solved quickly. Consumers may also use an out-of-court dispute resolution body where available, without losing the right to go to court.

If a clause of these Terms is invalid, the rest remains in force. These Terms and the Privacy Policy are the whole agreement between you and us about the App.
